Service Description Mertica is a marketing intelligence platform provided by Go Marketi LLC ("Company", "we", "us"). The platform enables digital marketing agencies to connect their clients' advertising accounts, view performance data in unified Arabic dashboards, receive AI-powered smart recommendations, and generate professional Arabic PDF reports. 2. Account and Responsibilities - You must be authorized to create an account on behalf of your agency. - You are responsible for maintaining the confidentiality of your login credentials. - You are responsible for all activities that occur under your account. - Information provided during registration must be accurate and up to date. - You must have the necessary authorization to connect your clients' advertising accounts through the platform. 3. Subscription and Billing - Mertica offers paid subscription plans with a free trial period. - Payments are processed through Stripe in US Dollars. - Subscriptions are monthly and auto-renew unless cancelled before the end of the current billing cycle. - You may cancel your subscription at any time through account settings. Cancellation takes effect at the end of the current billing cycle. - We do not offer refunds for partial periods. - Plan limits (number of clients, available features) are defined on the pricing page and enforced server-side. 4. Data Ownership - The agency retains full ownership of all its data and client data on the platform. - We reserve the right to use aggregated, anonymized data to improve our services and industry benchmarks. - Upon account cancellation, you may request to export your data within 30 days of cancellation. - After the 30-day period, your data will be deleted according to the retention policy specified in the Privacy Policy. 5. Prohibited Use You may not: - Use the platform for any illegal or unauthorized purpose. - Attempt unauthorized access to other agencies' or clients' data. - Resell the service or grant access to unauthorized parties. - Use the platform in a way that harms its performance or availability for other users. - Copy or extract platform content through automated means (scraping) without written permission. - Violate the Company's intellectual property rights. 6. Limitation of Liability - The platform is provided "AS IS" without any express or implied warranties. - We are not responsible for the accuracy of data pulled from advertising platforms through third parties. - We are not responsible for marketing decisions made based on AI recommendations. - In all cases, our total liability shall not exceed the amounts paid by you during the preceding three months. - We are not liable for any indirect, consequential, special, or punitive damages. 7. Termination - You may terminate your account at any time through account settings. - We reserve the right to suspend or terminate your account if you violate these terms. - If we terminate your account due to a violation, you are not entitled to any refund. - Sections relating to intellectual property and limitation of liability survive account termination. 8. Modifications We reserve the right to modify these terms at any time. We will notify you of material changes via email 30 days before they take effect. Your continued use of the platform after the changes take effect constitutes your acceptance. 9. Governing Law These terms are governed by the laws of the Kingdom of Saudi Arabia. The Board of Grievances in Saudi Arabia has jurisdiction over any dispute arising from or related to these terms. 10.
